Separate the employer credit from a personal childcare bill
An operating business can explore childcare assistance to improve hiring and retention, but the employer credit is not a general reimbursement for every daycare invoice paid by a founder. Start with the workforce need and the proposed delivery arrangement: an employer facility, a contract with a qualified provider, an intermediary arrangement, or resource and referral services. Identify who can use the program and what the business is actually buying before applying a headline tax percentage.
For qualifying amounts paid or incurred after December 31, 2025, section 45F uses forty percent of qualified childcare expenditures, or fifty percent for an eligible small business, plus ten percent of qualified resource and referral expenditures. The 2026 annual caps are five hundred thousand dollars and six hundred thousand dollars respectively. The enhanced small-business test uses the preceding five-year gross-receipts period, not a casual assertion that the company has few employees.
Model the expenditure categories separately
Assume a hypothetical eligible small business incurs one hundred twenty thousand dollars of qualified contracted childcare expenditures and ten thousand dollars of separately qualified resource and referral costs during 2026. Assume all employee-access, provider, contracting, and other requirements are met. The preliminary credit is sixty thousand dollars plus one thousand dollars, or sixty-one thousand dollars, before general-business-credit limitations and other applicable rules. The invoice total and the credit base need not be identical if some services are not qualified.
Now assume the entire one hundred thirty thousand dollars would otherwise be currently deductible, and the credit requires a sixty-one-thousand-dollar deduction reduction under the applicable rules. The remaining deduction is sixty-nine thousand dollars. At an illustrative twenty-one-percent income-tax rate, that deduction produces fourteen thousand four hundred ninety dollars of additional tax reduction. The combined simplified benefit is seventy-five thousand four hundred ninety dollars, leaving fifty-four thousand five hundred ten dollars of net cash cost. This assumes the full credit is currently usable; it is not a promise for a pass-through owner or a business with insufficient credit capacity.
Confirm the arrangement before promising the benefit
Obtain the provider contract, licensing evidence, service description, eligibility policy, fee schedule, and payment records. The statute addresses qualified facilities and nondiscrimination conditions. A program limited to the highest-paid executives can present a different qualification issue from a workforce-wide arrangement. If an intermediary is involved, document how its contracts connect the employer’s spending to qualified childcare services rather than treating any benefits-platform fee as qualified automatically.
Ask the advisor to verify the small-business calculation using the actual ownership group and receipts history. The IRS 2026 guidance identifies a thirty-two-million-dollar gross-receipts benchmark and the special preceding five-year period for this credit. Aggregation and other relevant rules need review. Keep the computation with the program file so the selected fifty-percent rate can be explained if the business grows, acquires another company, or changes ownership.
Distinguish an operating contract from a facility investment
An employer that constructs or acquires a childcare facility needs a separate basis and recapture analysis. The IRS explains that credit attributable to facility acquisition, construction, rehabilitation, or expansion reduces facility basis. A qualifying facility’s later cessation or ownership change can also trigger recapture within the statutory period, subject to applicable rules. A current credit should therefore be modeled beside the company’s longer-term property and operating commitment.
For a contracted program, establish how employee eligibility, provider licensing changes, unused slots, refunds, and contract termination will be monitored. If the business pays for capacity that does not meet the qualified-service rules, identify that amount separately rather than applying the credit percentage to the whole annual contract. Preserve corrected invoices and refunds so the year-end credit calculation follows the actual expenditure, not the budget approved months earlier.
Approve the commercial cost and the filing record together
Compare the proposed program with actual recruitment costs, employee demand, scheduling needs, and administrative capacity. A tax credit can reduce the net cost of a useful service, but it does not make unwanted capacity valuable. Give management a before-credit cash budget and a second scenario showing delayed use of the credit. That prevents a general-business-credit carryforward from being treated as cash available to pay the childcare provider this month.
At filing, reconcile qualified spending to the ledger, the credit calculation, any deduction or basis adjustment, and Form 8882 under the applicable current instructions. Review employee tax treatment separately; an employer credit does not establish that every employee benefit is excluded from wages. Retain the contracts and qualification analysis with the annual calculation, and keep facility records through any recapture period. The useful outcome is a workforce program with supported economics and reporting, not a large claimed credit attached to an unexplained childcare expense account.
